The ruling about whether internet operation comes under BR68 is contained
is written communications from the RA to a UK based amateur. I'll let him
identify himself and why the RA have made this ruling.

Nope. I didn't say that. Only if you can access the system via amateur
radio does it apply. e.g. I have a website (www.g7hud.com) and the WT Act
doesn't apply to that. However, I'm connected to GB7ESX at the moment via
the internet. Although I send a message to GB7ESX over the internet (no
radio involved) I am seen as using my amateur licence because other hams
can access the message I send by radio at GB7ESX, or any BBS that the
message is forwarded to.

True. However, the gateway station has to be reasonably sure that the
station connecting to them does have a radio licence before allowing the
connection to proceed. Of course some gateway stations take this
responsibility more seriously than others do. If someone in the UK without
a licence accesses a packet BBS via the internet without a licence, they
would be considered to be breaching the WT Act. The view in other
countries may well be very different.

No wrong again. As soon as any message that originates on GB7ABC is
accessed by radio on say GB7DBY (which has lots of radio access) then
GW3TMH's licence will be considered to have been used in sending the
messages from GB7ABC. Well according to the RA that is.

So then they are operating amateur radio without a licence and are open to
prosecution under different parts of the WT Act.
As to whether the RA are right about this is open to question.
