Re: VXA? Like, who else? OK, NOW I'm beginning to understand which case
you're talking about and it has nothing to do with California. Oh I'm
well aware of the poo storm over Google's refusal to remove the clips
from its child You Tube. Frankly I'm surprised they didn't as soon as
they were discovered as being offensive which is against their policy to
begin with. I've seen other things removed with a notice in their place
saying WHY and not all removed by You Tube, some were removed by the
poster.
I had no idea some judge refused to order removal, but I can understand
why, lack of jurisdiction. In the US at least there is no regulation of
content besides what a site owner allows which is why discussion forums
have moderators. You Tube has what amounts to the same thing and ISPs
have rules regulating what one can do and not do on the network but these
are private contractural matters while the internet itself has no
official government oversight therefore a judge cannot make a ruling
regarding it.
IMO this is a good thing, the internet is the only communication freedom
we have left so I'd hate the day the iron fist of government chokes it
off. Then there is packet where the bulk of communication these days is
via our own private reserved IP blocks, give thanks every time you
connect to the BBS that someone had the foresight to grant us our very
own internet within the world wide web.
