There seems to be some confusion about this matter.

  First divide the subject into P messages & Bulletins.

P messages:
           Whether a  P message  from a  CBer is  legal or  not depends on the
regulations in your country to third party traffic.

If your country does not permit third party traffic all P type CB messages are
illegal.

In Australia third party traffic is legal for a small number of countries.
If the message comes from one of these it is legal.
If it does not come from one of these it is illegal.
If it comes from the internet it is  legal if the country is one of the  third
party agreement countries.
Many messages to  yachts coming via  the internet are  illegal and are  in the
same category as messages from CBers.

Messages from an amateur in ANY country are legal.


B Bulletins:
            Bulletins from CBers are in  exactly the same category as bulletins
from NASA to  SPACE. They are  traffic on matters  that are newsworthy  and it
matters not where  the text originated.  How many times  have you seen text in
bulletins that have no relevence to amateur radio. So long as the bulletins do
not get  onto the  amateur network  by a  CB station  transmitting on  amateur
frequencies they are legal. If an  amateur operates two BBSs one on an amateur
band  and  the  other  on  CB  there  is no reason why he cannot copy the text
accross  from  one  to  the other  and  retransmit  the  bulletin  on  amateur
frequencies.  The fact that CB headers are in there is irellevent.
It is probably legal for him to operate one port on CB and the other on AR.
Just so long as the gateway is not enabled.

Now bear this in mind; If CB  bulletins are not legal then many bulletins also
containing text not written by amateurs are also illegal.
