Hi Paul and readers,
Now if as you say your legal system uses the ambiguous term "street
language" IT is even more woeful than anything else in this whole
discussion. That term leaves a wide open, gaping in fact loophole that
any slug can crawl through. Frankly sir I thought your legislators had
ordinary common sense, but according you you they don't have the brains
God gave a goose. With respect sir, I urge you to read and understand the
rules and regulations regarding the use of language and if need be those
which they make reference to the common law of your land. I have strong
suspicions that they are more specific than that.
Now you gon in the next paragraph in complete agreement with me that (in
effect) community standards apply. Now THIS is the meat of the matter and
in fact such standards do NOT apply to curse words nor swear words as
they are far removed from obscenity and indecency. Those two last words
are what apply and ONLY what apply to the judgement thereof by an average
person, the community at large.
It seems there is (as always) much confusion as to what swearing,
cursing, obsceneties and indecencies actually are. It is simply that
people don't know the proper definitions thereof and their differences,
therefore they constantly confuse one with another.
I believe you are among them sir since what you wrote about "street
language" simply makes no sense. Lawyers, judges, legislators and the
like are real sticklers for proper definitions and instruct the jury
accordingly so they may reach an informed and proper decision regarding
the disposition of any case.
No sir, I'm not a lawyer, but having sat in a courtroom often enough
listening to proceedings, I sure know all about how those "legal eagles"
argue minutia, and how the slightest mis step can decide a case.
In conclusion to all concerned, I have seen so many examples in this
discussion of people not knowing the difference between cursing,
swearing, obscenity and indecency that my suggestion to ALL is begin with
cracking open a dictionary. You don't need a degree in law, just a bit of
knowlege applied with common sense to avoid confusion and spreading
confusion.
I do hereby swear upon my keyboard the above is true to the best of my
knowlege and a curse upon any who disagree with me. (;->)
