Well I think Ralph must have a really bad case of the farmers and no
Preparation H to hand the way he is reacting.
There's no problem with the copyright issue. The law in the UK and
Australia is clear on the subject, if you write it then the copyright is
yours. However, some internet systems require you to assign the copyright
to them before they "publish" it. Check with the system.
There's no such agreement on packet so the copyright definitely belongs to
Ralph.
Does John's (G8MNY) use of the article appear to be fair use? I would say
it does. Now I cant find a copy of it on here so I cant see if John has
included a note saying who's work it is. But I have seen other bulls from
John that have acknowledged the source.
Furthermore, radio hams have long tradition of publishing, copying and
republishing and enhancing and deriving new work based on old work. If you
send something as a bulletin on packet I would suggest that if you don't
include a specific disclaimer on anything sent, then you have, based on the
past history of radio hams, already given tacit approval for the
recirculation of your work simply by not asking for it to NOT be
republished.
Now if Ralph didn't want it reprinting he had several choices. He could SP
John and ask him to stop or he could throw a hissy fit like a spoilt kid
and send a bull to @WW about how he was being wronged.
One would have had the effect that the disputed information would stop
being circulated by John and the other would be to make him look to all and
sundry like the petulant child, Verruca Salt, from Charley and the
Chocolate Factory.
I've enjoyed reading Ralph's musings on programming in the past and he's
made me stop and think. However, if in future, commenting on, quoting or
just generally reading any of Ralph's messages is going to open a quagmire
of copyright issues then I think a lot of people will just start to quietly
ignore whatever Ralph writes. Perhaps that's what he wants.
You maybe correct Ralph that your copyright is being infringed. But we
would have to ask what exactly are you losing by the infringement? I can
tell you that you've lost a lot of credibility and respect from the way
you've dealt with this.
